Expanding the Role of Paralegals

Abstract


The late jurist, Antonin Scalia, said the following: “The American ideal is not for some justice. It is, as the Pledge of Allegiance says, ‘Liberty and Justice for All’…Can there be a just society when some do not have justice? Equality, equal treatment, is perhaps the most fundamental element of justice.†Today access to justice is denied to the poor, the working poor, and in many instances to the middle class. Access to justice is expensive and the court house door is closed to far too many.

Paralegal graduates, particularly from American Bar Association approved programs, are highly capable of providing much of the needed legal services at a substantially reduced cost.

This paper advocates for expanding the role of paralegals to provide needed services and outlines the expanded use of paralegals in other jurisdictions.
